Terms
Bike Fit Studio: Supplemental terms
Version 1
Effective: 9 October 2026
These supplemental terms add to Montis's Terms of Service for Bike Fit Studio. Where they differ, these terms apply to Bike Fit Studio. Read them with the supplemental privacy notice and, for studios, the data processing agreement.
1. Who operates it
Bike Fit Studio ("bikefit"), at bikefit.montis.icu, is part of Montis.icu ("Montis"). As Montis's Terms say, Montis.icu is operated by Clive King from the Canton of Vaud, Switzerland. Notices to Montis under these terms, such as ending or a claim, go through the Bike Fit Studio contact page. A studio's agreement for Bike Fit Studio is with Montis. A client's booking is with the studio, not with Montis.
2. What Bike Fit Studio is
Bike Fit Studio is software for independent bike fitting studios. A studio's team uses it to run fits, keep client records and manage bookings. Clients book online on the studio's own page and can see their finished fits in My fits.
Montis is a platform provider only. It is not a party to any booking or fit. The contract for a fit is between the studio and its client. That covers the price, payment, changes, cancellations, refunds and complaints. Montis does not sell, provide or invoice fits, and it never holds clients' money.
Fit advice is the studio's service. It is not medical advice. Reference ranges, bikefit's automatic checks and the AI check only inform; the fitter decides.
The AI check and speech use AI models from third parties: Google (Gemini), OpenAI or Anthropic. The AI check uses the provider the studio picks; speech always uses Google (Gemini). Section 4 of Montis's Terms, "AI-assisted services", applies to them.
AI can be wrong. It can misread a recording or a fit, miss something important or suggest something unsuitable. Its answers can change as the providers update their models. The AI check never changes a value. Speech proposes values from what the fitter said, and none is saved until the fitter accepts it. The fitter checks every result before relying on it. The studio is responsible for the fit and its advice.
3. For studios
Accepting these terms
Montis sets up each studio in bikefit with its owner. The studio accepts these terms and the data processing agreement once, when its owner ticks to accept them in bikefit the first time they open the studio. bikefit records who accepted, which version and when. The owner confirms that they may agree to them for the studio. Montis's platform admins never accept for a studio. Later versions take effect as section 6 says.
The studio's responsibilities
The studio alone is responsible for:
- its fits, advice, fitters and staff;
- its prices: the studio enters a price per hour, and bikefit works out each session's price from it, shows it only if the studio chooses, and adds no VAT, so the studio enters the price a client must be shown, VAT included where due;
- its change and cancellation policy and every word it adds to its pages and emails;
- consumer law where it trades, for example Austria's Distance and Off-Premises Contracts Act (FAGG), including any right of withdrawal and the information it must give clients;
- its receipts, invoices and taxes;
- its imprint and privacy page, linked in its footer;
- checking that its booking page and emails meet the law where it trades.
Bike Fit Studio provides the tools: the booking page; a tick box that every client must tick, to agree to the studio's terms, before they can book online (it is never ticked in advance, and the studio cannot turn it off); standard texts and defaults; and a place for the studio's own words. Before it takes bookings, the studio checks that these suit its business, and tells Montis if a standard text does not fit the law where it trades. The studio's own words and the settings it chooses, including any default it keeps, are its responsibility.
Team, accounts and access
The studio decides who on its team uses bikefit, on its Access page. It keeps sign-ins secure and is responsible for what its team does in bikefit. It tells Montis at once if it believes access has been misused. Montis's platform admins (the people who run Bike Fit Studio for Montis) can open and change any studio's records and settings. They do so only to run, support and secure Bike Fit Studio, at the studio's request, or where the law requires it.
Acceptable use
Section 12 of Montis's Terms applies. In addition, the studio uses bikefit only for its own lawful business. It records only the client data it needs and has a lawful basis for it, including the client's consent for health details where required. It does not upload content it has no right to use.
The studio's content and its clients' data
The studio keeps its rights in its own content (its name, logo, texts and policy) and in its data. It lets Montis host, show and process them only to provide Bike Fit Studio. The studio is in charge of its clients' data (the controller), and Montis handles it only for the studio (the processor), under the data processing agreement.
Frames and geometry a studio adds to the shared bike database are there for all studios to use. While it uses bikefit, the studio can change or remove the ones it added. Those still in the database when the studio leaves stay there: the studio lets Montis keep and share them, free of charge. They must not include personal data.
The studio's own accounts with other services, such as its AI providers or, in future, Stripe, are under its own agreements with them. With the studio's own AI key, the provider works for the studio under that agreement. Where Montis sets up its own AI key for a studio, Montis's account with that provider is used instead, and the provider is Montis's sub-processor under the data processing agreement. Montis stores these keys encrypted and uses them only for what the studio's team does in bikefit, such as running the AI check, turning recorded speech into text or testing a key.
Fees and commission
Fees for Bike Fit Studio, if any, are those agreed between Montis and the studio. Bike Fit Studio does not take online payments today, so there is no commission. If a studio turns on online payments in future, clients will pay the studio directly into its own Stripe account: the studio will be the seller (the merchant of record), not Montis. Montis will then charge the studio a commission of 0 to 5% (the rate Montis sets for that studio) on what its clients paid online, VAT included and before Stripe's fees, less refunds. Where a studio owes Montis fees or commission, Montis invoices them monthly, plus VAT where due. Montis never adds them to what a client pays.
Montis may change its fees, or the commission rate within that range, with 30 days' notice by email to the studio's owners. A studio that does not accept a change may stop using Bike Fit Studio before it takes effect.
Availability and changes to the software
Section 14 of Montis's Terms applies. Bike Fit Studio is in active development and is provided on a best-effort basis. Montis may add, change or remove features. It will give reasonable notice before removing a feature a studio relies on, where practicable.
Montis does not promise that Bike Fit Studio will always be available, work without interruption or errors, or never lose data. It runs on other companies' services, such as Cloudflare's hosting and database, email sending and the AI providers, and their outages affect it too. Montis keeps database backups for up to 30 days, but does not promise that every record can be restored. The studio keeps its own copy of anything it can't do without; Montis prepares an export on request.
Suspension and ending
The studio may stop using Bike Fit Studio at any time. Montis may end a studio's use with 30 days' notice. Montis may suspend access at once, or end it, only for a material breach, a security risk, non-payment or where the law requires it, and tells the studio why.
However its use ends, Montis prepares an export of the studio's data on request, in a common format such as CSV or JSON, with its audio clips as files, if asked within 30 days, unless the law forbids it. Montis then deletes the studio's data as the data processing agreement says, except the frames it added to the shared bike database.
Liability
Bike Fit Studio is provided as it is and as available. To the extent the law allows:
- Montis is not liable for indirect or consequential losses, lost profits or revenue, or the cost of replacing lost data;
- Montis is not liable for loss or corruption of data, for interruptions, downtime or errors of Bike Fit Studio, or for outages of the services it runs on;
- Montis is not liable for the studio's services, prices, policy, payments or refunds;
- Montis is not liable for what the AI check, speech, the reference ranges or bikefit's automatic checks get wrong, or for decisions taken on them;
- Montis's total liability to a studio is limited to the fees the studio paid Montis in the 12 months before the event that caused the claim.
None of this limits Montis's liability for harm caused on purpose or through gross negligence, which Swiss law does not allow to be excluded in advance (Art. 100 of the Swiss Code of Obligations), or any other liability the law does not allow to be limited.
Indemnity
The studio protects Montis against claims that come from the studio's business. If a client, a payment provider, an authority or anyone else claims against Montis because of the studio's services, bookings, prices, policy, payments, refunds or chargebacks, its content, or its use of its clients' data, the studio pays Montis back for what the claim costs it, including reasonable legal costs. This does not apply as far as the claim is caused by Montis's own breach of these terms, the data processing agreement or the law, or by a standard text in bikefit that the studio cannot change. Montis tells the studio promptly about such a claim and lets it take over the defence where the law allows.
Law and courts
Swiss law applies between Montis and studios. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply, and neither do Swiss rules that would point to another country's law. As in Montis's Terms, the courts of the Canton of Vaud, Switzerland, decide disputes between Montis and a studio.
4. For clients
- Your booking is with the studio. So is any payment. The studio's change and cancellation terms (and its own general terms, if it links them), which you agree to when you book online, apply. While the studio takes bookings online, you can change or cancel online up to the time it sets; after that, and for questions, refunds or complaints, contact the studio: a reply to its booking emails, or a message on its contact page, goes to the studio.
- My fits and sign-in. You can sign in with a one-time link sent to your email, or with Montis. My fits shows your finished fits from every studio that has your email. The fits are the studio's records: ask the studio to correct them.
- Montis's role is limited. Montis provides the software only. It does not decide changes, cancellations or refunds, and it is not responsible for the fit or the advice.
- Your rights stay. Nothing in these terms takes away the rights the law gives you as a consumer, including under the law where you live.
5. Copyright
Bike Fit Studio © 2026 Montis.icu. The software, including its code, design, screens, texts, email wording and templates, is Montis's copyright, and Montis holds whatever rights exist in its reference ranges and in the bike database as it compiled them. Open-source parts keep their own licences. Studios, their teams and their clients get the right to use it while they have access, and nothing more. Studios may use and adapt Montis's templates within bikefit. Studios keep their own content and data.
6. Changes to these terms
Each change is a new version, published here with its version number and date. Montis tells studios about an important change at least 30 days before it takes effect, by email to their owners. A studio that does not accept it may stop using Bike Fit Studio before then. Using it after that counts as accepting the change, but never as giving up rights the law protects.
If any part of these terms is invalid, the rest still applies. For clients' data, the data processing agreement takes precedence over these terms.
7. Contact
For bookings, fits and refunds, contact the studio. For these terms or Bike Fit Studio, contact Montis through the Bike Fit Studio contact page.
